Udah biasa mereka mengatasnamakan DJP. Kalo di daerah-daerah biasanya mereka mengatasnamakan KPP atau Kanwil setempat. Kalo mau ikut teserah, jika tidak gak masalah juga. Laporkan aja mereka ke DJP, karena mengatasnamakan DJP. Setau saya kegiatan yang dilaksanakan oleh KPP tidak dipungut biaya, malah dikasih makan dan materinya juga.

(1) Terhadap Surat Pemberitahuan Tahunan Pajak Penghasilan Wajib Pajak Orang Pribadi yang

disampaikan sebagaimana dimaksud dalam Pasal 1 ayat (1), tidak dilakukan pemeriksaan,
kecuali:

a. terdapat data atau keterangan yang menyatakan bahwa Surat Pemberitahuan
Tahunan Pajak

Penghasilan tersebut tidak benar; atau

b. Surat Pemberitahuan Tahunan Pajak Penghasilan menyatakan lebih bayar atau
rugi.

(2) Dalam hal terhadap Surat Pemberitahuan Tahunan Pajak Penghasilan yang telah disampaikan
dilakukan

pemeriksaan karena memenuhi ketentuan sebagaimana dimaksud pada ayat (1) huruf a atau
huruf b,

Direktur Jenderal Pajak dapat menerbitkan surat ketetapan pajak dan/atau Surat Tagihan
Pajak atas

seluruh kewajiban perpajakan.

Saya baru aja ditanya bos soal sunset policy... udah dapat dari beberapa

sumber, tetapi guna melengkapi ada yang mau saya tanyakan :

1. Apakah benar bagi perusahaan yang menggunakan sunset policy & kurang

bayar tidak akan diperiksa? kebetulan kantor saya sejak tahun 2005 s/d

2007

kemarin tidak diperiksa karena kurang bayar.

2. Kalau memang ada jaminan tidak diperiksa? mohon dibantu dasar hukumnya

3. Apakah penghapusan policy ini bisa digunakan sebagai klaim tidak

diperiksa (jika pertanyaan 1 & 2 gak ada pemeriksaan) untuk pencabutan

NPWP

dalam rangka pemeriksaan terkait pencabutan NPWP karena alasan merger dan

acquisisi perusahaan?

Justru sepertinya harusnya tidak terkena potongan pph 21, 23, dan 26.
Kalau kami terbalik, sebagai penjual malah modern marketnya gak mau di potong. Susahnya karena mereka giant2 jadi posisi tawarnya kurang.
Tetapi kayaknya memang kasus ini debatable.

Memang apabila langsung dilakukan di faktur pajak penjual jelas sekali bahwa ppnnya otomatis berkurang dan tidak terkena pph21, 23 atau 26.
Tapi yang sering menjadi masalah adalah apabila bonus/cash discount atau apapun nama potongan rabatnya, karena istilahnya bisa macam2 terutama yang berhubungan dengan modern market, potongan tersebut biasanya dilakukan setelah barang terjual, bisa 2 atau 3 bulan kemudian. Memang modern market tsb menerbitkan faktur pajak untuk potongan tsb shg bagi penjual bisa memasukkannya sebagai pajak masukan.
Seharusnya atas transaksi tersebut efek PPNnya sama saja, tetapi yang jadi masalah adalah potongan tersebut kena pph 21, 23 atau 26 tidak ?
Kalau menurut surat S-29/PJ43/2003 tgl 29 jan 2003 ttg penegasan pengenaan pph atas potongan harga dan insentif penjualan ditegaskan sebagai berikut :

1. Sepanjang pot harga dan insentif penjualan yang diberikan kepada para pelanggan merupakan pengurangan harga untuk menentukan nilai penjualan bersih bagi penjual atau nilai harga pokok penjualan bagi pembeli, pot harga dan insentif penjualan tersebut bukan merupakan obyek pph 21, 23,atau 26.
2. Bila pot harga dan insentif penjualan dibarikan dalam pengertian hadiah maka terkena obyek pph 21, 23 atau 26.

Jadi menurut saya kalau kita berpegang pada nomor 1 tsb, walaupun tidak dalam 1 faktur pajak ( dlm artian faktur pajak pengurangnya diterbitkan oleh pembeli ), sepanjang kita sebagai penjual membukukan potongan tersebut sebagai potongan penjualan maka harusnya tidak terkena obyek pph 21, 23,atau 26.

Mohon apabila ada teman-teman yang bertugas di modern market memberikan pendapatnya juga.

Hmmm.. pertama baca pertanyaan ini saya bingung, kirain ada yang nanya
PPN atas bonus yang diterima karyawan menjelang akhir tahun :)

kalau saya tidak salah menangkap maksud pertanyaan pak Suria, Bonus
yang ditanyakan di sini adalah semacam 'rabat/cash discount' yang
diberikan setelah pembelian mencapai kumulatif jumlah tertentu.

Bonus/Cash discount tsb sesungguhnya merupakan volume discount yang
bisa menjadi pengurang nilai penjualan. Hanya saja memang dalam
administrasi PPN, agar bonus tsb dapat diperhitungkan sbg discount
harus dicantumkan dalam Faktur Pajak.

Volume discount tsb menurut saya juga bukan merupakan obyek PPh 23,
sepanjang telah dicantumkan sbg pengurang penjualan dalam faktur pajak.

Namun jika melihat fakta transaksi yang sudah dilakukan : Bonus tsb
telah dipotong PPh 23 dg tarif 15%; sepertinya oleh principal bonus
tsb dianggap sebagai 'hadiah/penghargaan' yang diterima oleh WP Badan.

nahh.. karena dianggap sbg hadiah.. kira2 bagaimana perlakuan PPN-nya?
apakah atas bonus/penghargaan tsb merupakan obyek PPN?
apakah dalam hal ini terdapat penyerahan BKP/JKP ?

Penyerahan BKP dari principal ke pembeli jelas sudah dikenakan PPN
berdasarkan harga jual, namun PPNyang terutang dibebaskan?

Bagaimana dg bonus yang diterima sehubungan dg penyerahan BKP tsb?

Maaf jika posting saya tdk menjawab pertanyaan.. sekedar membuka
wacana diskusi dulu :)

KPP memang dapat salinan putusan dari Sekretariat Pengadilan Pajak.

Sebelumnya maaf bilamana yg akan ditanyakan pernah dibahas, berikut ada yg perlu kiranya dpt dibantu terkait Ketentuan Perpajakan yg berlaku pada WP-Badan dgn status :
- PMDN
- PMA

Pertanyaannya :
1. Apakah ketentuan UU beserta Peraturan Pelaksanaan yg terkait, terdapat perbedaan baik secara jenis/obyek (PPh & PPN) maupun tarif pajak yg diberlakukan thdp PMDN & PMA?
2. Apakah kelebihan dari masing-2 status kepemilikan WP-Badan tsb, terkait dgn pemberian 'fasilitas' atas Investasi Asing?
3. Bgm pula dgn kelebihan dari BUT dibanding dgn WP-Badan dgn status PMA?
4. Berapakah ketentuan Proporsi Kepemilikan antara Lokal & Asing pada struktur Permodalan, shg suatu Badan dpt disebut PMA?
5. Apakah ada perubahan yg 'significant' pada UU-PPh yg mulai berlaku per 01 Jan 2009 thdp PMDN & PMA?

I was accosted (not really) today in the laundromat by a congressman.  Yes, in the laundromat !!!  He gave me his business card, told me his plan to give tax credits to people who adopt pets from the pound (this would help animals and save taxpayer money that gets used to euthanise them), shook my hand, and told me to vote for him.  That's the first time I've ever met a politician, I think !!!

[taxchat] Rental property in LLC

The attorney in my BNI group referred a new client to me a couple of months ago.  Last week she told me that the couple, both physicians, had purchased a rental property and that she formed an LLC for them.  She was going to put the rental property into the LLC. When I asked her why she formed the LLC, she said to give them a layer of protection. I said don't do anything until I check out a few facts regarding this.
 
The more experienced folks on this list always say to never put property into a corporation.  Now, they will have to pay the annual LLC fees to the STate of CT, and also file a 1065 for the rental....both costing the clients more money.  Does anybody see any problem by putting the rental into the LLC's name?

You quoted it more completely then I did. My point was more to the fact that what ever is said by politicians to get elected isn't their meaning for the most part after being elected.

Bush (W's father) that said "Read my lips." during the 1988 campaign, in response to a question about whether he would raise taxes.  He said he wouldn't.  The actual quote (or close to it) was: "Read my lips.  No new taxes."  After he was elected he raised taxes.  He knew what a death sentence for his campaign it would have been if he had said that he planned to raise taxes, as it was for Mondale's campaign in 1984.  Since then it's rare for a politician to say that he/she plans to raise taxes, even if they know it's likely they will have to after they're in office.
