Re: [forum-pajak] Audit Likuidasi

[1]. Melaporkan SPT adalah hak WP, tidak ada aturan yg melarang,
bisa kapan2 saja [dipercepat].
[2]. Membayar PPh adalah hak WP, tidak ada larangan pembayaran dipercepat,
[3]. Sebaiknya ke rek. pemegang saham.
Pemeriksaan karena SPT LB [thn terakhir] dan pemeriksaan pencabutan
NPWP adalah berbeda,
blm tidak bisa dilaksanakan sekaligus.
Tapi mungkin bisa bersamaan waktunya, hanya Surat Perintah
Pemeriksaannya
berbeda / terpisah.
Karena pemeriksaan atas pencabutan NPWP, tahun yg diperiksa belum
tentu
hanya tahun yg terakhir.

Mohon pencerahannya di kantor saya mengalami perubahan atas Chart of account di akhir tahun ini berdasarkan permintaan kantor pusat yang ada di LN dalam rangkan untuk system sentralisasi, Saat ini saya sudah lakukan perubahan untuk hal tersebut berdasarkan draft yang diminta kantor pusat . yang menjadi pertanyaan saya adalah apa yang harus saya lakukan baik dari sisi Accounting maupun Pajak untuk kedepannya dalam menghadai Audit keuangan ataupun Audit pajak.

Apabila ada pasal atau aturan untuk hal ini mohon diinformasikan

wah , boss pengalamannya sama dengan saya,

saya mendaftarkan npwp karyawan di kpp madya jakarta selatan
melalui e npwp. sudah 1 bulan ngga jadi jadi....

lalu saya laporkan di web site pengaduan pajak aja,...
wal hasil 2 hari kemudian saya ditelp AR saya kalo
Npwp tersebut telah selesai...

1. Saya setiap lapor Pajak di KPP Madya Jakarta Selatan pelayanannya lama
banget.

2. Saya mendaftarkan NPWP karyawan sudah lebih dari 3 Minggu di KPP Madya
Jakarta Selatan belum juga selesai tapi saya juga mendaftarkan NPWP untuk
karyawan perusahhan lain di KPP Pancoran dalam 1 Minggu sudah selesai.

Apakah rekan2 juga mengalami demikian ?......

Untuk perusahaan yang diikuidasi, apakah :

Mohon bantuannya,

Selama ini perusahaan kami membubuhkan stempel 'PPN/PPnBM tidak dipungut
berdasar Kepres no 96 Tahun 1993', bagi customer kami yang berada di kawasan
berikat& EPTE. Selama ini tidak ada masalah dengan penggunaan stempel tsb,
tetapi kemarin salah satu customer kami complain & minta diubah stempelnya
menjadi 'PPN/PPnBM tidak dipungut berdasarkan KEP Menkeu No.291/KMK.05/1997
Sebagaimana telah beberapa kali diubah terakhir dengan PMK
No.101/PMK.04/2005'. Alasannya adalah berdasarkan PER 159/PJ/2006 tentang
PPN & Faktur Pajak, dimana mengenai tatacara pemberian kode faktur pajak 07
ada disebutkan :

'Peraturan Pemerintah Nomor 33 Tahun 1996 tentang Tempat Penimbunan Berikat
yang diatur lebih lanjut dengan Keputusan Menteri Keuangan Nomor
291/KMK.05/1997 tentang Kawasan Berikat sebagaimana telah beberapa kali
diubah terakhir dengan Peraturan Menteri Keuangan Nomor 101/KMK.04/2005.'

Apabila argumentasi cuatomer benar berarti stempel untuk KBN & EPTE berbeda?


Bagaimana dengan stempel tidak dipungut bagi customer yang berada di pulau
Batam?

Saat ini di perusahaan kami yang dikuasakan untuk mendatangani faktur pajak
dan FPT masa PPN, PPh, dll sedang diluar kota. Saya mohon bantuan barangkali

dear all,,,,,,,,,,,

Saya masih kurang jelas nih " Sumset policy", kita kan di kasih
fasilitas penhapusan sanski administrasi berupa bunga atas pph yang
kurang bayar, gimana denga denda telat lapor kalo kita mau ber - npwp
sekarang dan menyampaikan SPT Tahunan PPh WPOP tahun 2006 s/d 2007,
apakah kita akan dikenakan denda telat lapor untuk SPT Masa Dan SPT
Tahunan-nya kalo kita adalah WPOP yang menjalankan pekerjaan bebas????
Gede jua ya kalo memang kena, pph kurang byr gk seberapa tapi denda
telat lapornya bisa-bisa lebih besar dr pph-nya.

1. Sehubungan keluarnya pp-51(jasa konstruksi) apakah per-70 (pph 23)
sudah tidak berlaku? PP-51 khusus untuk jasa kontraktor tetap berlaku mulai
1 januari 2008 sedangkan PER-70/2007 tetap berlaku juga. Khusus untuk
perusahaan jasa kontraktor mengacu pada PP-51/2008 bukan lagi pada
PER-70/2008. Makanya pada pp-51 tersebut tertulis segala peraturan yang
bertentangan dengan pp-51 dinyatakan tidak berlaku. Dengan demikian khusus
untuk perusahaan jasa konstruksi mengacu pada pp-51 tersebut.

2. Jasa instalasi/pemasanga n, jasa perawatan/pemelihar aa/perbaikan
dikenakan perhitungan pajak yang mana per-70 atau pp-51?
a. Kalau jasa instalasi/pemasanga n, jasa perawatan/pemelihar aa/perbaikan
dilakukan perusahaan kontraktor jika pekerjaan dilakukan oleh perusahaan
kontraktor tetap mengacu pada pp-51

b. Kalau jasa instalasi/pemasanga n, jasa perawatan/pemelihar aa/perbaikan
dilakukan bukan perusahaan kontraktor (bukan bidang usahanya) jika pekerjaan
dilakukan oleh perusahaan BUKAN kontraktor tetap mengacu pada per-70/2007

3. "Nilai Kontrak Jasa Konstruksi adalah nilai yang tercantum dalam
satu kontrak jasa konstruksi secara keseluruhan. "-penjelasan nilai kontrak
di pp-51; "3 1/3 % dari jumlah yang dibayarkan seluruhnya termasuk pemberian
jasa dan pengadaan material / barang tidak termasuk PPn"- penjelasan nilai
kontrak dari per-70; benarkah jika perusahaan kami memotong pph untuk jasa
konstruksi dari nilai kontrak total (material+jasa) ? karena beberapa
kontraktor memisahkkan tagihannya.berdasarkan pp-51 menyatakan semua
transaksi kontrak harus dikenakan pph final - pp51 sehingga pekerjaan
kontraktor termasuk jasa dan material dikenakan pp-51 tersebut. kecuali
material tersebut dibeli sendiri oleh perusahaan bapak sehingga dikontrak
hanya mencantumkan atas jasanya saja,. dengan demikian pajak yang dikenakan
pada perusahaan jasa kontraktor tersebut hanya dikenakan atas jasa tersebut.
Namun jika tercantum jasa dan material meskipun dibuat dalam kontrak
terpisah maka tetap dikenakan pp-51

4. Mohon penjelasan untuk pengertian jasa perantara, jenis kegiatan apa
saja yang termasuk? misalnya perantara jual-beli rumah

Saya di perusahaan sedang berhadapan dengan banyak kontrak
(kegiatan) pembagunan dan perbaikan. Saya hendak menanyakan beberapa hal,
antara lain;

1. Sehubungan keluarnya pp-51(jasa konstruksi) apakah per-70 (pph 23)

5. Perusahaan kami menerima invoice untuk kegiatan pengadaan acara
(property dan partisipan) tapi mereka menulis management fee=0 (nol) atau
tanpa management fee. Dan mereka menolak di potong PPh dengan alas an
management fee =0 dan sudah memotong ke pihak ke-3. Apa itu benar, apa tidak
ada masalah jika kami tidak memotong PPh-nya?

6. Perusahaan kami menyewakan bangunan, dan kami dipotong pph final
4(2). Mohon penjelasannya bagaimana pencatatannya secara akuntansi dan
pelaporannya di laporan keuangan dan SPT tahunan, terutama jika kami
menerima pembayaran sewa dimuka u 3 tahun misalnya dan sudah dipotong.

Mohon maaf jika pertanyaan saya banyak dan agak sulit dimegerti, maklum
masih awam.

[taxchat] Inherited Property

Please correct me if I am wrong I am trying to remember the rules on
inherited property.

When someone inherits a house it is not a taxable event until the day
it is sold and then the basis must be calculated ie. the value at the
time of death. Am I correct on thinking this?

When someone inherits cash it is not taxable unless interest is earned
on the cash - then the interest is income or if the cash was income to
the decedent. Am I correct on thinking this?

Sewa alat kantor termasuk objek PPh Pasal 23, tarifnya adalah 4,5% (15% x 30%) dari nilai kontrak atau penggantian tidak termasuk PPN.
Dasarnya adalah Peraturan Direktur Jenderal Pajak No.PER-70/PJ/2007.

[forum-pajak] Perhitungan PPH terhutang dalam sunset policy

Rekan2,

Tolong tanya mengenai perhitungan PPH terhutang yang dihitung ketika
memanfaatkan sunset policy.
Misalkan kita akan melaporkan aset rumah seharga 500 juta rupiah yang
kita beli pada tahun 2005 dengan memanfaatkan sunset policy.
Rumah seharga 500juta tersebut merupakan hasil dari penghasilan kita
dari tahun 2000-2004 (dimana saat itu belum mempunyai NPWP).

Cara perhitungan PPH yang mana yang akan digunakan?

A. Apakah perhitungan PPH terhutang akan diperhitungkan sebagai
pendapatan lain2 sehingga terkena perhitungan sbb:
25juta x 5% = Rp.1.250.000,00
25juta x 10% = Rp. 2.500.000,00
50juta x 15% = Rp. 7.500.000,00
100juta x 25% = Rp. 25.000.000,00
300juta x 35% = Rp.105.000.000,00
TOTAL = Rp.141.250.000,00

B. Atau PPH terhutang dapat diperhitungkan dengan asumsi merupakan
penghasilan selama beberapa tahun?
Misal penghasilan yang diperoleh untuk membeli rumah tsb merupakan
penghasilan yang diperoleh dari tahun 2000-2004 sbb:
Penghasilan Tahun 2000-2004 pertahunnya = Rp. 100juta
Jadi PPH terhutangnya per tahun =Rp.11.250.000,00
Jadi TOTAL PPH terhutang = Rp. 56.250.000,00
