Sekedar pendapat, sejak tahun 2009, penghitungan PPh Pasal 23 tidak lagi berdasarkan penghasilan neto, tapi imbalan bruto, jadi gak usah lagi dikali dengan 30%. Yang akan ditentukan oleh Menkeu adalah Jenis Jasa Lainnya, bukan perkiraan penghasilan netonya.

I said I'd try to get a cite for this question (why a mom & pop LLC can't
elect to be a Qualified Joint Venture) from earlier this week. I spent the
last two days at GearUp in OKC, and had a chance to ask an instructor
(Michael Gordon) for a cite. He said that GearUp's position comes, not from
the actual Code language of Sec 761(f), but from language contained in the
Small Business Work Opportunity Act of 2007, which has not yet been
integrated into the Code. But he didn't have a copy of the Act, and I can't
find any such language in the text of the Act, but only in the IRS
instructions for making the QJV election.

Sec 761(f) says....
*******************
2) QUALIFIED JOINT VENTURE- For purposes of paragraph (1), the term
"qualified joint venture" means any joint venture involving the conduct of
a trade or business if--

(A) the only members of such joint venture are a husband and wife,


(B) both spouses materially participate (within the meaning of
section 469(h) without regard to paragraph (5) thereof) in such
trade
or business, and

(C) both spouses elect the application of this subsection.

I don't think anything there precludes an LLC from making a QJV election.

The other interesting observation from the GearUp instructor was that, in
his opinion, the entire QJV code section 763(f) is redundant and basically
nuts. He said that any husband - wife partnership has always had this
option available to them statutorily, though he did not give me a cite for
that opinion.

What other kinds of joint ventures are there? It seems to me to be saying
that NO h/w partnership of any kind can make the election. But that would
seem to directly contradict the Code language.

Here's from the latest Gear Up manual on entities.  It's not authority but
indicates where the IRS is heading re whether an H/W LLC can file 2 Schedule
C's:

"NEW DEVELOPMENT:  While the IRS has yet to issue formal guidance on this
change, information on its website reveals that the IRS' position is that
the escape from partnership treatment for spousal business is limited in
scope.  It does not apply to spouses who operate in the name of a state law
entity.  The election can be made only for a business operated by spouses as
co-owners that is, or should otherwise be, taxed informally (my emphasis) as
a partnership.  Therefore, a business owned and operated by the spouses
through a Limited Liability Company, general partnership, or limited
partnership does not qualify for the election."

Based on that it appears that IRS is taking the position that H/W LLC's can
elect 2 Schedule C's.  Maybe we won't know for sure until after IRS issues
formal guidance and someone challenges it.

drake allows you to put J on a sched c, & the 8829 automatically goes to the
sched c also, but will create 1 SE's for each spouse.  WI doesnt say it
"wont" allow h/w llc's, so my guess is, you can file a joint sched C if
state law allows it.

Don't forget basic economics here (long run and short run changes)
plus we do not know about the "side" deals that are already in place
by prior Presidents.

Some things will improve and some things will get worst (tax brakes
in some areas and increases in others) The government has NEVER given
us a break with one hand witout taking it back with the other. Hey,
we are waiting for one increase already - the bailout package! Guess
who's paying for that.

I also have been here long enough not to believe the hoopla too.

saya akan memberi saran untuk maria atas pertanyannya.
Jenis pajak yang harus maria perhatikan antara lain :
1. PPh Pasal 26 atau P3B
maria harus memotong penghasilan yang diterima oleh Konsultan dari RRC sebesar imbalan yang diterima tidak termasuk PPN dengan tarif pasal 26
atau tarif P3B apabila Indonesia dengan RRC punya perjanjian P3B dng syarat konsultan RRC tersebut mempunyai COD atau surat keterangan
domisili yang asli
2. PPN
Maria harus memungut PPN 10% dari imbalan yang dibayar ke konsultan RRC

yg gw tau pajak khusus batubara ga ada jadi prhitungan pajak tahunan
sperti prush umum lainnya dan ppn langsung dibebankan sbg biaya.

untuk sewa stockpile yang dipotong pajak dari biaya sblm ppn:
sebelum 2009 : 15%*30% = 4,5% * by sewa
sejak 2009 : 2%*30% = 0,6% * by sewa

smoga benar dan bs mmbantu bu..

Saya di perusahaan sedang berhadapan dengan banyak kontrak
(kegiatan) pembagunan dan perbaikan. Saya hendak menanyakan beberapa hal,
antara lain;

1. Sehubungan keluarnya pp-51(jasa konstruksi) apakah per-70 (pph 23)
sudah tidak berlaku?

2. Jasa instalasi/pemasangan, jasa perawatan/pemeliharaa/perbaikan
dikenakan perhitungan pajak yang mana per-70 atau pp-51?

a. Kalau jasa instalasi/pemasangan, jasa perawatan/pemeliharaa/perbaikan
dilakukan perusahaan kontraktor

b. Kalau jasa instalasi/pemasangan, jasa perawatan/pemeliharaa/perbaikan
dilakukan bukan perusahaan kontraktor (bukan bidang usahanya)

3. "Nilai Kontrak Jasa Konstruksi adalah nilai yang tercantum dalam
satu kontrak jasa konstruksi secara keseluruhan."-penjelasan nilai kontrak
di pp-51; "3 1/3 % dari jumlah yang dibayarkan seluruhnya termasuk pemberian
jasa dan pengadaan material / barang tidak termasuk PPn"- penjelasan nilai
kontrak dari per-70; benarkah jika perusahaan kami memotong pph untuk jasa
konstruksi dari nilai kontrak total (material+jasa)? karena beberapa
kontraktor memisahkkan tagihannya.

4. Mohon penjelasan untuk pengertian jasa perantara, jenis kegiatan apa
saja yang termasuk?

5. Perusahaan kami menerima invoice untuk kegiatan pengadaan acara
(property dan partisipan) tapi mereka menulis management fee=0 (nol) atau
tanpa management fee. Dan mereka menolak di potong PPh dengan alas an
management fee =0 dan sudah memotong ke pihak ke-3. Apa itu benar, apa tidak
ada masalah jika kami tidak memotong PPh-nya?

6. Perusahaan kami menyewakan bangunan, dan kami dipotong pph final
4(2). Mohon penjelasannya bagaimana pencatatannya secara akuntansi dan
pelaporannya di laporan keuangan dan SPT tahunan, terutama jika kami
menerima pembayaran sewa dimuka u 3 tahun misalnya dan sudah dipotong.

Mohon maaf jika pertanyaan saya banyak dan agak sulit dimegerti, maklum
masih awam.
